Challenging Obama's Presidency

Lawsuits challenging Barack Obama's citizenship are being perpetually rejected.

A little known aspect of the judicial system was made a bit more public recently, as courts have rejected lawsuits challenging the legitimacy of Barack Obama’s presidential election.

Anthony Martin-Trigona, a documented legal system abuser, did it again, filing a lawsuit regarding Obama's citizenship in Hawaii state court. Federal courts have already imposed rules barring him from bringing any more frivolous claims to their courts.

A federal appeals court has previously described Martin-Trigona’s actions and called out the harm caused by people who use our justice system for their own personal agenda without regard to the legal validity of their claims.

“To those who follow the business of the courts, the appellant needs no introduction. He is the source of literally hundreds of lawsuits, motions and miscellaneous pleadings, all but a small fraction of which lack any merit whatsoever. Viewing Martin-Trigona's litigious conduct in its entirety yields the inescapable conclusion that he persistently resorts to legal processes without regard to the merits of the claims asserted and that he invokes those processes largely to harass persons who have unluckily crossed his path."

And the 2nd Circuit Court of Appeals continued:

"Martin-Trigona is known to have filed over 250 civil actions, appeals, and other matters throughout the United States, which have been pursued with 'persistence, viciousness, and general disregard for decency and logic.'  He has used legal pleadings to ventilate his contempt and hatred of persons of Jewish heritage and to level accusations which 'have often been personal, have often emphasized racial or religious affiliations, and have often involved the members of . . . judges' and counsel's families.' The purpose, nature and effect of his resort to multiple litigation has been to involve as many persons in as many confounding legal processes as possible. . . . Martin-Trigona's voluminous filings have 'inundated' the District of Connecticut and his activities have burdened judicial operations to the point of impairing the administration of justice. Finally, Martin-Trigona has not desisted from his course of vexatious litigation but has expressly stated his intent to file yet more actions.”

Fox News put Martin-Trigona on the air during the campaign to impugn Obama.  The real offense, political positions aside, was that a person known for such extensive and frivolous abuse of the American legal system was given the credibility of broadcast time.

But he is not alone.  Seventeen lawsuits (so far) have been filed in various jurisdictions, claiming Barack Obama was not born a U.S. citizen, and thus, cannot become president.

The facts:

Hawaii achieved statehood in 1959.  Obama was born in Hawaii in 1961.   Obama’s birth certificate, conveying U.S. citizenship and noting birth in Hawaii's capital, Honolulu, has been examined by the State of Hawaii and found to be authentic.

Case closed.

None-the-less, seventeen individuals have filed suit, and upon rejection of their claims by trial judges, have appealed as high as the U.S. Supreme Court.  The legal basis of the challenges is Article II of the U.S. Constitution, requiring a president to be a natural-born citizen.  Precious resources are used, briefs read, arguments heard, all to give every possible advantage to litigants who want their day in court.  To date, the U.S. Supreme Court has rejected two petitions that have made it to the court for consideration.

The "natural-born citizen" clause has received publicity in recent years with California Republican Governor Arnold Schwarzenegger, who is an Austrian-born, naturalized U.S. citizen, appearing to emerge as a presidential hopeful, except for Article II.  Discussion was also prompted by the candidacy of Republican Presidential aspirant John McCain, was born in the Panama Canal Zone to a U.S. military family.  McCain, however, was a citizen at birth, via his parents, both citizens and the status of the U.S.-controlled Canal Zone.

Can you imagine challenges to the birth certificates of George W. Bush, William Jefferson Clinton, George H.W. Bush, or Ronald Reagan?

Obama only has a substitute document called,"Cettificate Of Live Birth." He, nor anyone else, has produced a "Birth Certificate."
A Certificate Of Live Birth does not have as much detail, as a required Birth Certificate.
He has continued to offer for proof, any Birth Certificate.

WHY DID HE NOT HAVE A BIRTH CERTIFICATE? I THINK HE WAS NOT BORN IN AMERICA BUT IN KENYA OR POSSIBLY HE WAS ADOPTED SO HE SHOULD NOT HAVE BEEN ALLOWED TO RUN FOR THE OFFICE.

There was no question about the birth place of GWB, WJC, Bush 41, or RR. It was public record. There is considerable question about that of BHO, who has sealed not only his birth documents but his school papers as well. If he has nothing to hide, release them. End of question. He has three law firms working for him on this issue; Why? There has been too much hidden (by our government and those in power) over the years, for the citizens of this country to accept- at face value- assurances that 'all is well' in Mudville.

Obama's sealing of all his records leads one to believe something is greatly amiss!

Until I see a real document ascertaining his legitimacy I will not consider this man to be the President of the United States. The truth is never locked up, only lies and falsehoods are. There are too many inconsistencies in his actions, words and the reports of his background. An honest man does not have a need to hide anything. This is not about democrat vs. Republican or Black vs. White, it's about America, it's values and our future as a free people.

It has been tossed out of court, get over it. Personally I don't care where he was born. If he and his administration can pull this country out of the mess it is in he will get my vote. If GW has taught us anything it's being born in the US doesn't make you a good president.

Did you really expect anything differnt, this would put everything in a chaotic crazziness. Their reasoning behind this is we can not go against the will of the people. How convient this is for the courts, a bunch of people on the courts without any backbone!

@ Steve: I have given some weight to courts that have looked at the Obama challenge lawsuits and called them frivolous. However, a little research into the facts as reported in credible newspapers and websites adds some strong details. For example, the Heath Department in Hawaii has checked and verified their own original records showing Obama's birth in Hawaii. The document that Obama has made available and which is reproduced in the LA Times and other news organization websites is regarded by the Health Department as an appropriate document showing birth in Hawaii. A typical birth announcement was printed in the local paper in Hawaii the week after Obama's birth. "Mr. and Mrs. Barack H. Obama . . . son, Aug. 4. These facts seem so strong; why would should the public be suspicious. There are rumors going around the Internet telling different stories, but the facts from reporters across the country seem to be the same.

On this christmas eve I would hope people would stop being so frivilous. Lets just hope that the president elect has more insight than did his predicessor. Time to stop being racial, we are all children of God, and had Obama been white no one would have made those stupid accusations.I hope he has the answers for our future, and for the futures of our children and grandchildren. This is easily as ridiculous as GWB becoming president after the FL debacle. I never considered him a president since they suspended voters that were perfectly legal and threw out the counties where there were the most likely Dem votes, yet he was still able to send my cousin off to get killed in Iraq. We can't change that now nor can we change the fact that Obama is going to be our president for the next 4 years. Take the good with the bad you bunch of hillbillies, what you call good and bad is up to you, but you have to play by the rules on both sides.

This just goes on and on, if he's legit, show a birth certificate, unlock his college records, and so on. Nothing asked that wouldn't be asked of any candidate. Messing with the constitution is the only sure fire way to destroy this country.

You would not challange other Presidents like Bush or Clinton as thier parents were both born in US and so were they. Not true of our new Pres Nobama. He has not provided an actual Birth Certificate and one of his parents was here less then the required time. IT warrants a look from the Supreme Court.

Keep filing those suits! Someone is bound to listen and get to the bottom of this sham of a President soon.

I don't care if he is from the land of OZ. This nation needs help! GWB, has taken this country to it knees, high unemployment, broke, deep in wars on two fronts and the list goes one. GWB and his crook VP have sold this country out, look at who is getting tha bail out money. Not the American people, it the old rich buddy club.

I don't care who takes the helm, as long as it is in a postive directions. I highly recommend reading a new book by Jim Marrs, called Rise of the Fourth Reich. Its very eye opening.

Barack Obama was by far the best canidate for the job and huge task at hand. You naysayers who are still bellyaching about a birth certificate need to get a grip and support our new president and pray he can do better than the last eight years of total embarasment for our cheif due to his own bankrolling attitude and total diregard for human lives. Believe me when I say the man is sill considering how we will view his legacy as a president..... 2. People who are dissatisfied with the outcome of the presidential election are going to grasp at straws. You have diehard Democrats and Republicans who will not be satisfied with any candidate but their own.

Simply stated...If Barak Obama is proven to NOT BE be a United States Citizen by Law and is ineligible to be President, and then Joe Biden would also be ineligible.

The third in line would be Nancy Pelosi because she is Speaker of the House of Representatives.

I don't think that any attorney in his right mind would want that, so Barak will not be fought on the issue of "Birth Certificate".

I have checked out factcheck.org

Fact is, Obama's Father never applied to the U.S. Embassy to have Obama's Birth Certificate changed from being a British Citizen to a U.S. Citizen.

I received this information from a well known BBC commentator who has researched this intensely and found the Birth Certificate of Obama's Father. (In Kenya)

As I have Stated, under Law, if the Parents are of differing Citizenships (no matter what Country Born in) the child is of the Father's Nationality until:

The Father applies and is Granted a change of Citizenship for him or for the Child.

Lets check out our old friend John McCain. Home brith has made a come back because of the awful health care system we have. Would you be trying to make such an issue if McCain had won? Lets check out Sarah Palin and all her children's brith records, also Ab and G. Washington, Martin Luther King, better yet your own great grands. america's the melting pot; that's what i was lead to believe, back in the 70's as an elementary school student. there's million's of people out there who will take a mole hill and turn it into a mountain. personally i'am just grateful that the man was born, where he was born should'nt really matter; the man was willing to put his life on the line to serve our country, and straighten out a mess that he had no hand in. president obama, madam first lady you have my full support as a citizen to promote change.

@ johnaustin: Obama was a citizen at birth. That is according to U.S. law. Kenyon or U.K. law govern only whether he was also a citizen of those nations. We have a constitution for a reason. BHO's own grandmother said that he was born in Kenya. He attended a school that only allowed African born citizens to attend. Kick him out and all of his stupid bills and executive orders will be null and void. I pray for the day !!!

To me, this Birth Certificate thing is a non-issue. It is only a flaw in our Constitution. But it is "Interesting".

President Obama was Elected by a Majority...Let us leave it at that and go on.

More and more everyone should be realizing that the stupidest and most hateful people are the main population of the republican party. Bush was everything that was not elected, not intelligent, not capable, not worth a darn, not truthful, and not a legitimate president either time. Cheating in Florida and then cheating in Ohio. No one was beating this constantly in the media. No just the liars that make up the republican racist white wacko party are beating this lie about our rightfully elected President Obama.
